These Terms of Service ("Terms") govern your use of the Axara website and accessibility scanning service ("Service") operated by Axara ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.
1. Description of Service
Axara provides automated web accessibility scanning and monitoring tools. Our Service uses the open-source axe-core library to analyze websites for WCAG 2.1 Level AA compliance violations. We provide compliance scores, detailed violation reports, continuous monitoring, PDF report generation, and compliance badges.
2. Account Registration
- You must provide a valid email address and create a secure password (minimum 8 characters) to register.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- You may not create multiple free accounts to circumvent usage limits.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Free Scans
- All visitors may perform free accessibility scans without an account.
- Free scans are limited to 3 per IP address per hour to prevent abuse.
- Free scan results show your compliance score and top 10 issues. Full reports require a paid subscription.
- Free scan data is stored for 24 hours, then automatically deleted.
4. Paid Subscriptions
- Billing: Paid plans are billed monthly via Stripe. Your subscription renews automatically each month until you cancel.
- Free trial: New subscribers may receive a free trial period. You will not be charged until the trial ends. You may cancel before the trial expires to avoid charges.
- Cancellation: You may cancel your subscription at any time from your dashboard. Access continues through the end of your current billing period. No refunds are provided for partial months.
- Price changes: We may adjust pricing with 30 days' notice via email. Price changes take effect at the start of your next billing cycle.
- Refunds: We do not provide refunds except in cases of billing errors or service outages lasting more than 48 hours. Contact us within 14 days of a billing issue to request review.
5. Acceptable Use
You agree not to:
- Use the Service to scan websites you do not own or have authorization to test
- Attempt to overload, disrupt, or interfere with our servers or infrastructure
- Reverse-engineer, decompile, or extract source code from our proprietary systems
- Use automated scripts or bots to access the Service beyond our published API
- Resell or redistribute our Service, reports, or data without written permission (except for white-label reports included in the Agency plan)
- Use the Service for any unlawful purpose or to facilitate illegal activity
6. Scanning Limitations
- We only scan publicly accessible web pages. We do not log in to websites or access authenticated content.
- Scan results are generated by automated tools and may not identify all accessibility issues. Automated testing typically covers 30-40% of WCAG criteria.
- Our scans do not constitute legal advice or a certification of compliance. We strongly recommend supplementing automated scanning with manual accessibility audits for full compliance.
- We are not responsible for the accuracy or completeness of third-party content referenced in scan results (such as WCAG documentation links).
7. Intellectual Property
- The Axara name, logo, and proprietary software are our intellectual property.
- Your scan data and reports belong to you. You may download, share, and use them as you see fit.
- The axe-core accessibility engine is open-source software licensed under the Mozilla Public License 2.0 by Deque Systems.
- You retain all rights to your website content. Providing a URL for scanning does not grant us any rights over your content.
8. Compliance Badge
- Paid subscribers may embed an Axara compliance badge on their website.
- The badge displays your current accessibility score and updates automatically.
- The badge must link back to Axara or your scan report. You may not alter the badge design or misrepresent your score.
- If your subscription lapses, the badge will display a generic message instead of your score.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Axara SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:
- Your use of or inability to use the Service
- Any inaccuracies in scan results or compliance scores
- Unauthorized access to or alteration of your data
- Any legal action taken against you related to accessibility compliance
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THAT SCAN RESULTS WILL IDENTIFY ALL ACCESSIBILITY VIOLATIONS OR THAT ACHIEVING A HIGH SCORE GUARANTEES LEGAL COMPLIANCE.
11. Indemnification
You agree to indemnify and hold harmless Axara, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
12. Termination
- You may delete your account at any time, which terminates these Terms.
- We may suspend or terminate your account if you violate these Terms, with or without notice depending on severity.
- Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days unless legally required to retain it.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
14. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
